Welcome to Protokl. These Terms of Service ("Terms") constitute a legally binding agreement between you and Protokl ("we," "our," or "us") regarding your use of the Protokl mobile application and related services.
By downloading, installing, accessing, or using Protokl, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the app.
Your use of the App is also subject to Apple's Standard Licensed Application End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict between these Terms and Apple's EULA, Apple's EULA shall take precedence.
You must be at least 13 years of age to use Protokl. If you are between 13 and 18 years old, you must have parental or guardian consent to use the app.
By using the app, you represent and warrant that you have the legal capacity to enter into these Terms and that you are not prohibited from using the app under applicable laws.
IMPORTANT: Protokl is a fitness tracking and wellness tool and is NOT a medical device, medical service, or substitute for professional medical advice, diagnosis, or treatment.
You should always consult with a physician or qualified healthcare provider before starting any fitness program, changing your diet, or making any decisions based on information provided by the app. You should seek immediate medical attention for any health concerns and always follow your healthcare provider's recommendations over any information provided by Protokl.
YOU ACKNOWLEDGE AND AGREE THAT YOU USE PROTOKL AND PARTICIPATE IN ANY FITNESS ACTIVITIES ENTIRELY AT YOUR OWN RISK. We are not responsible for any injury, illness, death, or any adverse health effects resulting from your use of the app, reliance on any data displayed by the app, or any fitness activities you undertake based on information provided by the app. You should stop any activity immediately if you experience pain, dizziness, discomfort, or other adverse symptoms.
Protokl provides projections, forecasts, and estimates based on physiological research and algorithms. These are estimates only. We make no guarantees regarding weight loss, muscle gain, body composition changes, or any other fitness outcome. Individual results vary significantly based on genetics, adherence, medical conditions, and numerous other factors outside our control.
Nutritional information and meal recommendations provided by Protokl are for general informational purposes only. They are not a substitute for professional dietary advice. We do not guarantee the accuracy of nutritional data for any food item. Users with food allergies, intolerances, or medical dietary restrictions should consult a registered dietitian or physician.
Protokl displays data synced from Apple HealthKit and other sources. We do not guarantee the accuracy, completeness, or reliability of data from third-party devices, sensors, or platforms. Do not make medical decisions based on data displayed in the app.
You are responsible for maintaining the confidentiality of your account credentials, all activities that occur under your account, and notifying us immediately of any unauthorized access or security breach.
You agree to use Protokl only for lawful purposes and in accordance with these Terms. You must not violate any applicable laws, infringe on the rights of others, upload malicious code, attempt unauthorized access to our systems, or use the app for any commercial purpose without authorization.
You are solely responsible for the accuracy of information you enter, photos and content you upload, and ensuring you have rights to any content you share.
You represent that you are in adequate physical condition to engage in the fitness activities you track with Protokl, and that you have obtained any necessary medical clearances before beginning a fitness program.
Protokl and all its content, features, functionality, algorithms, and forecasting models are owned by us or our licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the app for your personal, non-commercial fitness tracking purposes.
You retain ownership of content you create and upload to the app. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing app functionality.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Protokl offers auto-renewable subscription plans that provide access to premium features. Subscription pricing and features are clearly displayed within the app before purchase.
Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
You can manage your subscription and turn off auto-renewal at any time by going to your Account Settings in the App Store after purchase. You may also manage subscriptions via Settings > [Your Name] > Subscriptions on your iOS device.
Protokl may offer a free trial period for new subscribers. Any unused portion of a free trial period will be forfeited when you purchase a subscription to the same offering. If a trial converts to a paid subscription, your Apple ID account will be charged at the subscription rate displayed at the time of enrollment.
You may cancel your subscription at any time. Upon cancellation, you will retain access to premium features until the end of the current billing period. Refunds are subject to Apple's App Store refund policies. We do not delete your data upon subscription cancellation.
We reserve the right to change subscription pricing. You will be notified in advance of any price changes, and changes will not affect your current billing period.
Protokl integrates with third-party services including Apple HealthKit and RevenueCat. Your use of these integrations is subject to the terms and privacy policies of those platforms. We are not responsible for the practices, policies, or availability of third-party services, and any interruption or change in third-party services does not entitle you to a refund.
PROTOKL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR UNINTERRUPTED OPERATION.
WE DO NOT WARRANT THAT: (A) THE APP WILL MEET YOUR REQUIREMENTS; (B) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE APP WILL BE ACCURATE OR RELIABLE; (D) ANY FORECASTS, PROJECTIONS, OR ESTIMATES WILL BE ACCURATE; OR (E) ANY DEFECTS IN THE APP WILL BE CORRECTED.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE APP SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROTOKL, ITS OWNER, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, REVENUE, DATA, OR USE; PERSONAL INJURY OR PROPERTY DAMAGE; BODILY HARM; EMOTIONAL DISTRESS; OR ANY OTHER DAMAGES ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (C) ANY DATA OR CONTENT OBTAINED FROM THE APP; (D) YOUR RELIANCE ON ANY INFORMATION PROVIDED BY THE APP, INCLUDING WORKOUT RECOMMENDATIONS, NUTRITIONAL INFORMATION, BODY COMPOSITION FORECASTS, OR ANY OTHER DATA; OR (E) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100 USD).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.
You expressly acknowledge and agree that any physical exercise, dietary changes, or health-related activities you undertake in connection with your use of Protokl are done at your sole risk. You voluntarily assume all risks of injury, illness, damage, or loss that may result from such activities. This assumption of risk includes, without limitation, risks arising from improper exercise form, overexertion, pre-existing medical conditions, allergic reactions to foods, or equipment malfunction.
You agree to indemnify, defend, and hold harmless Protokl, its owner, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the app; (b) your violation of these Terms; (c) your violation of any rights of a third party; (d) any injury or harm to yourself or others resulting from your fitness activities, dietary choices, or reliance on information from the app; or (e) any content you submit or share through the app.
You may stop using the app at any time by deleting it from your device. We reserve the right to suspend or terminate your access for violation of these Terms or any other reason at our sole discretion. Termination does not relieve you of obligations incurred prior to termination.
Before filing any formal legal action, you agree to first contact us at protoklapp@gmail.com and attempt to resolve the dispute informally for at least 30 days.
These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions.
YOU AGREE THAT ANY CLAIMS SHALL BE BROUGHT ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Any legal action arising from these Terms must be brought in the courts located in the Province of Alberta, Canada, and you consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with the Privacy Policy and Apple's Standard EULA, constitute the entire agreement between you and Protokl regarding your use of the app and supersede all prior agreements and understandings.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms in the app and updating the "Last Updated" date. Your continued use of the app after changes constitutes acceptance of the modified Terms.
